< 간암 진단이 지연된 사례 >

 

Q. 2018. 10. 8. 피신청인 의원에서 초음파 검사를 하고 불과 4개월 만에 15cm 크기의 간암이 확인된 것을 볼 때, 피신청인의 부주의한 초음파검사 때문에 간암이 진단되지 못했다고 추정됨. 간암 진단이 초기에 이루어졌다면 완치율 및 생존율이 현재보다는 좋았을 것이나, 피신청인의 진단지연으로 심각한 신체적, 정신적 피해가 발생했으므로 배상을요구함.

 

A. 피신청인 의원에서 시행한 초음파 검사상 2017. 10. 8.까지의 영상에서는 간암 소견이 명확히 확인되지 않고, 2018. 4. 15. 신청외 건강검진기관에서 시행한 초음파 검사에서도 간암 소견이 명확하게 확인되지 않음. 그러나 2018. 10. 8. 초음파 검사에서는 간암을 의심할 만한 소견이 확인됨에도 피신청인이 이를 진단하지 못해 4개월 정도의 진단

 

지연이 발생했다고 판단됨. 따라서 이에 대한 피신청인 의원의 배상책임이 인정됨.

(책임제한) 신청인에게 발생한 침윤형 간암의 경우 성장 속도가 빠르고, 치료에 반응이 좋지 않아 예후가 나쁜 것으로 알려져 있어 2018.10. 8. 간암이 진단되었다 해도 예후가 현재와 크게 달라지지 않을 수 있는 점, 의료의 특수성 등을 고려해 피신청인의 책임을 일부 제한함.

<Cases of delayed liver cancer diagnosis>

 

Q. 2018. 10. 8. When it was found that liver cancer of 15 cm in size was confirmed only 4 months after an ultrasound examination at the respondent's clinic, it is presumed that liver cancer was not diagnosed due to the respondent's careless ultrasound examination. If the diagnosis of liver cancer was made at an early stage, the cure rate and survival rate would have been better than the present, but the respondent's diagnosis delay caused serious physical and mental damage, so compensation is requested.

 

A. According to the ultrasound examination conducted by the respondent's clinic, the findings of liver cancer were not clearly confirmed in the images until October 8, 2017, and the findings of liver cancer were also clear from the ultrasound examination conducted by a health examination institution other than the application on April 15, 2018. Not confirmed. However, the respondent could not diagnose liver cancer even though the ultrasound examination on October 8, 2018 confirmed the findings of suspicion, it was diagnosed for about 4 months.

 

It is determined that a delay has occurred. Therefore, the Respondent's liability for compensation is recognized.

(Liability limitation) In the case of invasive liver cancer that occurred in the applicant, the growth rate is fast and the prognosis is known to be poor due to poor response to treatment. 8. Even if liver cancer is diagnosed, the Respondent's responsibilities are partially limited in consideration of the fact that the prognosis may not change significantly from the present and the specificity of medical care.
